Winneba High Court Affirms Essel Amoquandoh Royal Twidan Family’s Ownership of Gomoa Fetteh Kakraba Land

The Winneba High Court has brought renewed calm to a long-standing land dispute at Gomoa Fetteh Kakraba in the Central Region after affirming that the disputed parcel of land belongs to the Essel Amoquandoh Royal Twidan Family.
The judgment, delivered on May 28, 2026, by His Lordship Justice Baah Forson Agyapong, reaffirmed the ownership rights of the Essel Amoquandoh Royal Twidan Family over the disputed land, which forms part of a larger tract measuring approximately 75 acres (32.58 hectares), including Site B, which covers approximately 9.15 acres (3.71 hectares).
The court noted that the ownership of the land had previously been established in a Consent Judgment delivered on March 19, 2009, by Her Ladyship Justice Mrs. Owusu Arhin, then a High Court Judge in Cape Coast. The judgment clearly identified the disputed land as part of the plaintiffs’ family property.
According to the plaintiffs, the 1st and 2nd defendants violated the terms of the 2009 settlement by granting interests in portions of the land beyond the areas allocated to them under Sites A and B. They further alleged that the defendants collaborated with other families to create additional interests in the family land, leading to disputes and disturbances in Gomoa Fetteh Kakraba.
The plaintiffs argued that the defendants had no lawful title to the disputed land apart from the portions originally granted to them by the plaintiffs’ ancestors. They maintained that they had enjoyed peaceful possession of the land until the defendants allegedly began unlawfully selling and allocating portions of it to third parties.
The suit further stated that the defendants and their grantees had continued construction activities on the land despite protests, prompting the plaintiffs to seek the intervention of the court. They requested declarations that any registrations made in favour of the defendants by the 3rd defendant were null and void and asked the court to direct the cancellation of any such registrations involving third parties.
After hearing both sides, the Winneba High Court ruled in favour of the Essel Amoquandoh Royal Twidan Family and held that the disputed land rightfully belongs to the family.
The court also awarded damages against the defendants, granting GH¢40,000 to the Essel Amoquandoh Royal Twidan Family and an additional GH¢80,000 to Nana Yaw Kwadromanu II, Omankrado of Gomoa Fetteh Kakraba, for trespass and related claims.
The ruling is expected to restore peace and certainty over ownership of the disputed land and bring an end to years of conflict in the area.
